These Terms of Service (“Terms”) govern your access to and use of webcreationsuite.com and the WebCreationSuite ecosystem, including our web applications, software, APIs (if any), and related services (collectively, the “Services”). The Services are provided by WebCreationSuite s.r.l. (“WebCreationSuite,” “WCS,” “we,” “us”).
By accessing or using the Services, you agree to these Terms. If you are using the Services on behalf of a business or other entity, you represent that you have authority to bind that entity, and “you” refers to that entity as well as you personally. If you do not agree, do not use the Services.
These Terms are intended to be enforceable for users and customers in the EU/EEA, United Kingdom, United States, and Canada, and may also apply elsewhere, subject to mandatory local consumer laws where applicable.
1. About WebCreationSuite and the Services
WebCreationSuite is an ecosystem of web applications and tools designed to help businesses build, operate, and scale digital workflows. The current MVP includes PrintFlow, Parcely, and a basic version of myBusiness (business management, teams and users, calendar, chat, and project management). WCS may introduce additional modules, features, integrations, and plans over time. We may also provide tracking and measurement tools such as the WCS Pixel, which is currently used on our site and may later be made available to customers for use on their websites.
Some features may be offered as free, trial, paid subscription, or usage-based services. Any feature-specific terms, order forms, plan descriptions, or pricing pages are incorporated by reference into these Terms.
2. Eligibility and age restrictions
The Services are intended primarily for professional and business use. You must be legally able to enter into a binding contract in your jurisdiction. You may not use the Services if you are under the minimum age required by local law for data processing consent and contracting. Where applicable (including under U.S. law), the Services are not directed to children under 13, and you may not use the Services if you are under 13. If you are between 13 and the age of majority in your jurisdiction, you may use the Services only if your parent or legal guardian agrees to these Terms on your behalf to the extent required by law.
3. Accounts, WCS ID, and security
To use many features you must create an account (“WCS ID”) and provide accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us promptly at privacy@webcreationsuite.com or via support channels if you suspect unauthorized access.
We may implement security measures such as multi-factor authentication, login alerts, session controls, or device verification. You agree not to circumvent or interfere with security features or access controls.
4. Business workspaces, teams, and permissions
The Services may allow you to create or join a business workspace, invite team members, and assign roles and permissions. You are responsible for ensuring that (a) you have the right to invite users and process their information as required, and (b) permissions are configured appropriately for your organization.
If you are the workspace owner or administrator, you represent and warrant that you have authority to act on behalf of the workspace and its users, and you are responsible for the activity of users you invite, to the extent permitted by law.
5. Customer Content and your responsibilities
“Customer Content” means any content, data, files, documents, text, images, messages, project data, or other materials that you or your users submit, upload, transmit, store, or process through the Services (including via PrintFlow and Parcely).
You retain all rights in your Customer Content. We do not claim ownership of Customer Content.
You are solely responsible for (a) your Customer Content, (b) ensuring you have all rights, permissions, and lawful bases to submit and process that Customer Content, and (c) the legality, accuracy, and integrity of that Customer Content. You must not submit Customer Content that violates applicable law or third-party rights, including privacy, intellectual property, or confidentiality obligations.
You agree not to submit Customer Content containing highly sensitive information unless strictly necessary and lawfully permitted. If you do submit such information (for example, special category data under GDPR), you do so at your own risk and must ensure you have a valid legal basis and appropriate safeguards.
6. License to operate the Services
To provide the Services, you grant WCS a limited, non-exclusive, worldwide license to host, store, process, transmit, display, and otherwise use Customer Content solely to provide, maintain, secure, and improve the Services, to prevent fraud and abuse, to comply with law, and as otherwise permitted by these Terms and our Privacy Policy.
This license continues for as long as Customer Content is stored in the Services, subject to deletion and retention rules described in our Privacy Policy and any applicable DPA.
7. Acceptable use and prohibited activities
You agree to use the Services only in compliance with these Terms and applicable law. You must not, and must not allow others to:
Use the Services for unlawful, harmful, fraudulent, or deceptive purposes, including to violate privacy rights, run unauthorized tracking, distribute malware, or conduct phishing.
Interfere with or disrupt the Services, attempt to gain unauthorized access to systems, bypass rate limits, scrape or probe the Services in a way that degrades service or compromises security, or attempt to reverse engineer or extract source code except to the extent such restrictions are prohibited by mandatory law.
Upload or transmit content that infringes intellectual property rights, violates confidentiality, contains illegal material, or is abusive, defamatory, or harassing.
Use the Services to build or operate competing products by copying our user experience, features, workflows, or proprietary materials, except where expressly permitted in writing by WCS.
We may suspend or terminate access if we reasonably believe you have violated these Terms, created security risk, or used the Services in a way that could harm WCS or others.
8. WCS Pixel and tracking tools
If WCS provides tracking or measurement tools (including the WCS Pixel) and you deploy them on your websites or apps, you are responsible for ensuring that your use complies with all applicable laws, including providing required notices and obtaining consent where needed (for example, for cookies, targeted advertising, or retargeting). You must configure the tools appropriately and respect user preferences and opt-out signals where required.
WCS may provide documentation, settings, or consent-aware features to support compliance, but you remain responsible for your legal obligations as the operator of your website or app.
9. Third-party services and integrations
The Services may integrate with or link to third-party services (for example, payment processors, analytics, email delivery, CDNs, or other tools). Your use of third-party services is governed by the third party’s terms and policies. WCS is not responsible for third-party services, their availability, security, or how they process data, except as required by applicable law and as expressly stated in a written agreement.
10. Plans, trials, billing, and taxes
Some Services may be offered for free, on a trial basis, or as paid subscriptions. Pricing and plan features are described on our website or in an order form. Unless otherwise stated, fees are billed in advance, are non-refundable, and do not include taxes.
If you purchase paid Services, you authorize us (and our payment processor Stripe) to charge your payment method for recurring fees and applicable taxes. You are responsible for providing accurate billing information and keeping it up to date.
We may change pricing or plan features by providing notice in advance where required. Changes typically apply at the next renewal or billing cycle unless otherwise required or permitted by law.
11. Service availability, changes, and discontinuation
We aim to keep the Services available and reliable, but we do not guarantee uninterrupted operation. The Services may be subject to maintenance, upgrades, outages, or changes.
We may modify, add, or discontinue parts of the Services, including features, modules, or integrations. If a change materially reduces core functionality of a paid plan, we will provide reasonable notice where practicable and required by law.
12. Support
We provide support via our proprietary helpdesk and support channels. Support availability, response times, and scope may vary based on your plan and the nature of the issue. We may request information necessary to diagnose issues, including logs or screenshots, and you agree to provide reasonable cooperation.
13. Privacy, data protection, and DPA
Our Privacy Policy describes how we process personal data as a Controller. For business customers where WCS acts as a Processor, a Data Processing Agreement (DPA) may apply and may be made available upon request or through your account: [●].
You agree to comply with all applicable privacy laws and to provide any required notices and obtain any required consents related to your use of the Services, including when you deploy tracking technologies (such as WCS Pixel) or process personal data of your customers or end users.
14. Intellectual property
WCS and its licensors retain all rights, title, and interest in and to the Services, including all software, designs, user interfaces, templates, workflows, documentation, trademarks, and all related intellectual property rights. Except for the limited rights expressly granted in these Terms, no rights are granted to you.
You may not use our trademarks or branding without prior written permission, except as required to accurately refer to WCS when describing your use of the Services.
15. Feedback
If you provide feedback, suggestions, or ideas to WCS, you grant WCS the right to use them without restriction or compensation, and without any obligation to you, unless prohibited by law.
16. Suspension and termination
You may stop using the Services at any time. We may suspend or terminate your access to the Services (or a workspace) if we reasonably believe you have violated these Terms, created risk or harm, failed to pay fees, or if required by law.
Upon termination, your right to use the Services ends. Data deletion and retention follow our Privacy Policy and any applicable DPA. Some provisions of these Terms survive termination, including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution provisions.
17. Disclaimers
To the maximum extent permitted by law, the Services are provided “AS IS” and “AS AVAILABLE.” WCS disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.
Some jurisdictions do not allow the exclusion of certain warranties, so some of these disclaimers may not apply to you.
18. Limitation of liability
To the maximum extent permitted by law, WCS will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, goodwill, or business opportunities, arising out of or related to the Services or these Terms.
To the maximum extent permitted by law, WCS’s total liability for any claim arising out of or related to the Services or these Terms will not exceed the amount you paid to WCS for the Services that gave rise to the claim in the 12 months before the event, or €100 if you have not paid anything, unless mandatory law requires otherwise.
Some jurisdictions do not allow certain limitations of liability, so these limitations may not apply to you.
19. Indemnification
To the maximum extent permitted by law, you agree to indemnify and hold harmless WCS and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to (a) your use of the Services, (b) your Customer Content, (c) your violation of these Terms or applicable law, or (d) your deployment or configuration of tracking tools (including WCS Pixel) on your properties.
In some jurisdictions, indemnification obligations may be limited or not enforceable for consumers; in those cases, this section applies to the extent permitted by law.
20. Governing law and dispute resolution
EU/EEA and UK users
If you are located in the EU/EEA or the UK and use the Services as a consumer (where applicable), mandatory consumer protection laws of your country of residence may apply and may not be waived. Otherwise, unless required by mandatory law, these Terms are governed by the laws of Italy, without regard to conflict-of-law rules. United States and Canada users
For users located in the United States or Canada, unless prohibited by mandatory law, these Terms are governed by the laws of Italy, without regard to conflict-of-law principles. Any dispute will be brought in the courts of [●], unless mandatory local law provides otherwise.
We may offer alternative dispute resolution options or mandatory processes where required by local law. If we do, we will describe them in applicable notices or addenda.
21. Changes to these Terms
We may update these Terms to reflect changes to the Services, legal requirements, or business practices. We will post the updated Terms on /terms and update the “Last updated” date. If changes are material, we will provide additional notice where required by law. Your continued use of the Services after the effective date of the updated Terms constitutes acceptance of the updated Terms.
